These Terms of Service govern your use of Eireplan, an AI-assisted planning intelligence and workflow platform. By accessing or using Eireplan, you agree to be bound by these terms.

Introduction and Acceptance

If you are using Eireplan on behalf of an organisation, you represent that you have authority to bind that organisation to these terms. If you do not agree to these terms, please do not use the platform.

Description of the Service

Eireplan provides decision-support tools for planning professionals, including document management, research assistance, validation checks, precedent analysis, and AI-assisted drafting features.

The platform is designed to support professional planning workflows in Ireland. Eireplan does not replace professional judgment, statutory assessment, or legal advice.

Eligibility and User Accounts

To use Eireplan, you must be at least 18 years of age and have the legal capacity to enter into contracts. You are responsible for maintaining the confidentiality of your account credentials.

You agree to provide accurate and complete information when creating an account and to update this information as necessary. You must notify us immediately of any unauthorised use of your account.

User Responsibilities and Acceptable Use

You agree to use Eireplan in accordance with applicable laws and these terms. You must not:

• Use the platform for unlawful purposes or in violation of any regulations
• Attempt to gain unauthorised access to other accounts or systems
• Upload malicious software or content that infringes third-party rights
• Interfere with the operation of the platform or circumvent security measures
• Resell or redistribute access to the platform without authorisation

Intellectual Property

The Eireplan platform, including its software, design, and documentation, is protected by intellectual property laws. You retain ownership of content you upload to the platform. By uploading content, you grant us a limited licence to process that content to provide the service.

We do not claim ownership of your project data, documents, or outputs created using Eireplan.

AI Features and Limitations

Eireplan includes AI-assisted features for document analysis, policy referencing, and drafting support. These features are provided as decision-support tools only.

Important:

• AI outputs are assistive only and require professional review
• The platform does not provide legal, planning, or professional advice
• AI-generated content may contain errors and should not be relied upon without verification
• You are responsible for reviewing and validating all outputs before use

Accuracy, Reliance, and Disclaimer

While we strive to provide accurate and useful information, Eireplan does not guarantee the accuracy, completeness, or timeliness of any content or outputs generated by the platform.

You acknowledge that planning regulations and policies change over time, and information presented through the platform may not reflect the most current requirements. Professional verification remains essential.

We disclaim responsibility for decisions made based on platform outputs. The responsibility for professional judgment and statutory compliance rests with you.

Subscriptions, Fees, and Billing

Access to Eireplan may require a paid subscription. Subscription fees, billing cycles, and included features are described at the time of purchase.

Subscriptions renew automatically unless cancelled before the renewal date. We may change subscription fees with reasonable notice. Refunds are provided in accordance with our refund policy, available on request.

Service Availability, Changes, and Updates

We aim to provide reliable access to Eireplan but do not guarantee uninterrupted availability. The platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue features of the platform. Where significant changes affect your use of the service, we will provide reasonable notice.

Limitation of Liability

To the maximum extent permitted by law, Eireplan and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

Our total liability for any claims arising from these terms or your use of the platform shall not exceed the amount you paid for the service in the twelve months preceding the claim.

This limitation does not exclude or limit liability that cannot be excluded under applicable law.

Indemnity

You agree to indemnify and hold harmless Eireplan and its operators from any claims, losses, or damages arising from your use of the platform, your violation of these terms, or your infringement of any third-party rights.

Termination and Suspension

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access if you breach these terms or for other reasons with reasonable notice.

Upon termination, your right to use the platform ceases. We may retain certain data as required by law or for legitimate business purposes.

Governing Law and Jurisdiction

These terms are governed by the laws of Ireland. Any disputes arising from these terms or your use of Eireplan shall be subject to the exclusive jurisdiction of the courts of Ireland.
